These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of milehighvapes.com, including the purchase of any physical goods, digital content, or wholesale distribution agreements. By accessing this website or executing a purchase order, you agree to be bound unconditionally by these terms. If you do not agree to these terms, you must immediately cease use of our platform.

Mile High Vapes: Elevating the Standard of Premium Botanical Extractions.

1. Scope of Products and Commercial Goods

Mile High Vapes specializes in the retail and B2B wholesale distribution of premium vaporization hardware, botanical derivatives, and high-viscosity extracts. Our catalog heavily features advanced technological hardware designed specifically for the consumption of thick concentrates, notably premium resin liquid formulations.

The purchaser acknowledges that the hardware provided—including pod systems, 510-threaded cartridges, and sub-ohm tanks—is engineered to process resin liquid at specific temperature thresholds to prevent degradation of terpene profiles. Any use of incompatible carrier fluids or non-regulated e-liquids voids all manufacturer and distributor warranties.

2. Trade Terms, Pricing, and B2B Wholesale Distribution

For our commercial partners, wholesale distributors, and international clientele navigating commercial transactions, Mile High Vapes operates under strictly defined International Commercial Terms (Incoterms® 2020) unless a separate Master Service Agreement (MSA) dictates otherwise.

2.1 Applicable Trade Terms

• FOB (Free On Board): For bulk domestic freight containing hardware and compliant resin liquid cartridges, the risk of loss transfers to the buyer once the goods pass the ship’s rail or are loaded onto the contracted motor carrier at our Denver, CO facility.
• EXW (Ex Works): Buyers electing to utilize their own logistics networks must collect the goods directly from our warehouse. The buyer bears all costs and risks involved in taking the goods from our premises.
• DDP (Delivered Duty Paid): In select, compliant international markets where hardware sales are permitted, Mile High Vapes may assume maximum obligation, managing all shipping costs, export/import duties, and taxes to the buyer’s destination.

3. Product Disclaimers and Limitations of Liability

All products, including raw botanical flowers and hardware meant for resin liquid vaporization, are sold “AS IS” and “WHERE IS” without any express or implied warranties of fitness for a particular purpose, beyond the mandatory consumer guarantees required by the State of Colorado.

To the maximum extent permitted by applicable law, Mile High Vapes, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the products; (ii) any conduct or content of any third party regarding the products; and (iii) any unauthorized access, use, or alteration of your transmissions or content.

4. Risk of Loss, Title, and Bill of Lading

Title to the goods, including high-value resin liquid derivatives and extraction hardware, passes to the purchaser upon our delivery to the primary carrier. For B2B wholesale transactions, a clean Bill of Lading (BOL) issued by the carrier serves as absolute proof of the transfer of risk. Any claims for shortages, defects, or damages must be submitted in writing within forty-eight (48) hours of receipt of the shipment, accompanied by photographic evidence and the original BOL.

5. Indemnification

You agree to defend, indemnify, and hold harmless Mile High Vapes and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service and Products, by you or any person using your account and password; b) a breach of these Terms; or c) the improper modification of hardware for use with non-approved resin liquid alternatives.

6. International Sales and Export Control

Select products, primarily empty vaporization hardware and battery units, may be available for international shipping. However, products containing botanical extracts, including any resin liquid, are strictly prohibited from international export without explicit legal authorization and CIF (Cost, Insurance, and Freight) agreements governed by appropriate regulatory bodies. Buyers are entirely responsible for understanding their local import laws.
